As recognized by FHWA 29CFR 1.6

All actions modifying a general wage determination shall be effective with respect to any project to which the determination applies, if notice of such actions is published before contract award (or the start of construction where there is no contract award), except as follows:

In the case of contracts entered into pursuant to competitive bidding procedures, a modification, notice of which is published less than 10 days before the opening of bids, shall be effective unless the agency finds that there is not a reasonable time still available before bid opening to notify bidders of the modification and a report of the finding is inserted in the contract file.

A copy of such report shall be made available to the Administrator upon request. No such report shall be required if notice of the modification is published after bid opening.

The date that the rates are published, is the date they are effective for all projects that have not yet opened for bids. We will make every possible effort in getting the most current wages into our projects, without delaying the bid opening.

If there is not time, notify bidders of a revision prior to bid opening, document the exclusion with the job file memorandum (DOCX 31KB). This acknowledges that there are revisions to the Wages incorporated into the contract, but there was not enough time to include the revisions.

A change order will be issued for any revisions that directly effected the wage rate in the contract.

Should a wage determination fail to be incorporated in part or entirely in a covered contract and/or a wage determination has incorporated that clearly does not apply to the contract (e.g. inaccurate description of project, inaccurate location in a wage determination request), what should be done?

a) Document
b) Incorporate a valid wage determination retroactive to the beginning of construction through supplemental agreement or through change order. The contractor must be compensated for any increases in wages resulting from such contract change. 29 CFR 1.6(f)

If a contract has not been awarded within 90-days after bid opening, modifications prior to award to a general wage determination in the contract shall be effective with respect to that contract unless the agency requests and obtains an extension of the 90-day period from the USDOL Wage and Hour Division.

Slow down on ice and snow.
